Penalty Abatement

The IRS can add penalties to the tax debt due for numerous reasons.

Some of these include the following:

  1. if the taxpayer fails to pay.
  2. if the taxpayer fails to file.
  3. the taxpayer pays late.

The reason the IRS imposes penalties on the taxpayer is to persuade her to fulfill the obligations voluntarily. The IRS wants the taxpayer to be in compliance, which means paying her taxes due, filing her tax returns in a timely and efficient manner, and preparing an accurate and correct return.

The taxpayer may be able to qualify for relief from penalties if she falls under the following categories:

  1. reasonable cause
  2. statutory exceptions
  3. administrative waivers
  4. correction of service error

Penalty abatement is a common strategy and the IRS will take into consideration all of the taxpayer's circumstances and the facts surrounding her situation that led to the assessment of the penalties she accrued. Tax relief could be granted for the taxpayer under reasonable cause if it was proved that she exercised normal business care and caution in the handling of her tax obligations but through no fault of her own was unable to pay. Some of the following may allow the taxpayer to apply for reasonable cause:

  1. death, any serious illnesses, and also unavoidable absence
  2. if the taxpayer was unable to obtain records
  3. if the taxpayer receives incorrect advice from the IRS
  4. if the taxpayer receives incorrect advice from her tax advisor
  5. fire, casualty, any natural disasters or other disturbances not allowing the taxpayers to comply
  6. if the taxpayer experiences a service error
